Will I violate the TOS if..........

I have read your TOS thoroughly & the line "No mass mailers / spammers" confuses me.
Now I have three questions and I want them to be answered separately to avoid confusion.
Q) I am planning to install a newsletter system script which off course has mass email sending option but If I use it for just storing the emails of the users who subscribe through my main website. Will this violate your TOS.
Q) All websites are manually reviewed by humans,so will they block my account by seeing the script in root folder...even if I am not using it for sending mass mails but only collecting them........
Q) Can I use G Mail SMTP server to send mass mails(not spam mails) to my subscribed users. Will This violate your TOS.

Yes, you can use gmail SMTP server.
